{"id":23653,"date":"2025-01-01T04:17:19","date_gmt":"2025-01-01T03:17:19","guid":{"rendered":"https:\/\/test.cfdfeaservice.it\/index.php\/2025\/01\/01\/interpello-n-8-2024-chiarimenti-sul-numero-massimo-di-partecipanti-ai-corsi-di-sicurezza\/"},"modified":"2025-01-01T04:17:19","modified_gmt":"2025-01-01T03:17:19","slug":"interpello-n-8-2024-chiarimenti-sul-numero-massimo-di-partecipanti-ai-corsi-di-sicurezza","status":"publish","type":"post","link":"https:\/\/test.cfdfeaservice.it\/index.php\/2025\/01\/01\/interpello-n-8-2024-chiarimenti-sul-numero-massimo-di-partecipanti-ai-corsi-di-sicurezza\/","title":{"rendered":"INTERPELLO N. 8\/2024: CHIARIMENTI SUL NUMERO MASSIMO DI PARTECIPANTI AI CORSI DI SICUREZZA"},"content":{"rendered":"<div>\n<p>Con l\u2019Interpello n. 8\/2024, la Commissione per gli Interpelli risponde al quesito posto dalla Universit\u00e0 di Siena riguardante al <strong>numero di partecipanti ai corsi rivolti agli studenti <a>universitari<\/a><\/strong> che rientrano nella definizione di \u201c<strong>lavoratori equiparati<\/strong>\u201c.<\/p>\n<h2 class=\"wp-block-heading\"><strong>QUESITO PRESENTATO DALL\u2019UNIVERSIT\u00c0 DI SIENA<\/strong><\/h2>\n<p>Il quesito a cui l\u2019Interpello ha dato risposta riguarda la possibilit\u00e0 di derogare al limite di 35 partecipanti per <a href=\"https:\/\/www.vegaformazione.it\/PB\/corsi-sicurezza-obblighi-contenuti-modalita-p362.html\" target=\"_blank\" rel=\"noreferrer noopener\">corso di formazione<\/a> previsto dall\u2019Accordo Stato-Regioni del 21 dicembre 2011 e riconoscere come equivalenti ai corsi di formazione ad alto rischio ex art. 37 del D.Lgs. 81\/08 gli insegnamenti universitari che rispettano standard accademici, pur prevedendo un numero di studenti universitari, che rientrano nella definizione di \u201clavoratori equiparati\u201d, superiore a tale limite.<\/p>\n<h2 class=\"wp-block-heading\"><strong>NORMATIVA ATTUALE SUL NUMERO MASSIMO DI PARTECIPANTI AI CORSI DI FORMAZIONE<\/strong><\/h2>\n<p>Ad oggi, il limite massimo di discenti\u00a0in un corso di formazione in materia di salute e sicurezza sul lavoro \u00e8 conforme a quanto richiesto dall\u2019<strong>art. 37, comma 2 del D.Lgs. 81\/2008<\/strong> e dall\u2019<strong><a href=\"https:\/\/www.vegaengineering.com\/wp-content\/uploads\/2021\/04\/Accordo_Formazione_Lavoratori_21-12-2011.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Accordo Stato Regioni del 21\/12\/2011<\/a><\/strong>.<\/p>\n<p>L\u2019Accordo del 21\/12\/11, in attuazione dell\u2019articolo 37, comma 2, del <a href=\"https:\/\/www.vegaformazione.it\/h\/dlgs81-2008-h1.html\" target=\"_blank\" rel=\"noreferrer noopener\">decreto legislativo 9 aprile 2008, n. 81<\/a>, stabilisce:<\/p>\n<ul class=\"wp-block-list\">\n<li>per ogni corso di formazione \u00e8 previsto un numero massimo di <strong>35 partecipanti<\/strong>.<\/li>\n<li>i <strong><a href=\"https:\/\/www.vegaformazione.it\/PB\/formazione-lavoratori-salute-sicurezza-lavoro-p73.html\" target=\"_blank\" rel=\"noreferrer noopener\">contenuti della formazione<\/a><\/strong> generale, rivolta a tutti i lavoratori, e della formazione specifica per i lavoratori in base ai rischi legati alle loro mansioni.<\/li>\n<li>pur rispettando le regole sui contenuti e la durata dei corsi di cui ai punti precedenti, le modalit\u00e0 di svolgimento della formazione possono essere definite tramite <strong>accordi aziendali<\/strong>, previa consultazione con il rappresentante dei lavoratori per la sicurezza.<\/li>\n<\/ul>\n<p>Anche l\u2019<strong><a href=\"https:\/\/www.vegaengineering.com\/wp-content\/uploads\/2021\/04\/Accordo_Stato_Regioni_formazione_RSPP_7-7-16.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Accordo del 7 luglio 2016<\/a><\/strong> prevede, al punto 12.8, che in tutti i corsi di formazione sulla salute e sicurezza sul lavoro, salvo nei casi in cui siano previsti limiti specifici, il numero massimo di partecipanti non debba superare le <strong>35 unit\u00e0<\/strong>. In tale accordo \u00e8 inclusa una \u201cTabella riassuntiva\u201d che descrive i criteri per la formazione delle persone con ruoli legati alla prevenzione dei rischi sul lavoro, riportando il numero massimo di partecipanti in base ai destinatari dei corsi.<\/p>\n<p>Infine, <strong>l\u2019interpello n. 2 del 18 aprile 2024<\/strong> della Commissione per gli interpelli in materia di salute e sicurezza sul lavoro ha affrontato questa stessa questione. LA RISPOSTA DELLA COMMISSIONE INTERPELLI<\/a><\/p>\n<h2 class=\"wp-block-heading\"><strong>LA RISPOSTA DELLA COMMISSIONE INTERPELLI SUL NUMERO MASSIMO DI DISCENTI<\/strong><\/h2>\n<p>La Commissione conferma che, secondo la normativa attuale, il numero massimo di partecipanti a ogni corso <strong>deve rispettare quanto stabilito al punto 12.8 e nell\u2019Allegato V dell\u2019Accordo del 7 luglio 2016<\/strong>, firmato dalla Conferenza Stato-Regioni.
